Do I have to have health insurance?

 

The simple answer is “yes,” almost everyone, under the new Health Care Reform Law will be required to have health insurance coverage whether through their employer or through the Marketplace, also known as Exchanges, beginning on January 1st, 2014. There has been a six week extension (until March 31, 2014) for individuals to sign up for coverage and avoid the fine. You can begin to purchase individual coverage which will meet the requirements of Health Care Reform now - regardless of when the deadline is to avoid the penalty - to ensure that you have quality insurance in place for you and your family.  

Possible exemptions from this new law include:

  • Those with certain religious beliefs that oppose the acceptance of benefits from a health insurance policy
  • Members of Native American Tribes
  • Undocumented immigrants
  • Individuals in prison
  • Individuals whose income is below a certain level

Costs of Not Having Insurance:

Under the law, those who don’t have coverage will be responsible for paying all of their medical bills out of pocket and most people will have to pay a fine. For 2014, if you don’t have coverage you may owe a fine of $95 per adult and $47.50 per child (up to $285 per family) or 1% of family income, whichever is higher. Over the next few years that fine will continue to increase dramatically. In 2015, the penalty will be $325 per adult and $162.50 per child (up to $975) or 2% of family income, whichever is greater. Penalties in 2016 and beyond will be $695 per adult and $347.50 per child (up to $2,085 for a family) or 2.5% of income, whichever is greater. Fines will be prorated based on the number of months that you and your family go without coverage but there is no penalty for a gap in coverage of less than 3 months.
